Terms of Service

These terms govern your use of Digital Heritage. We have written them in plain language because we believe you deserve to understand what you are agreeing to.

Important: We Are a Vault, Not a Law Firm

Digital Heritage provides tools to help you organize, store, and share personal and legal documents. We are not attorneys and do not provide legal advice. Document templates provided through our service are starting points only — they are not legally binding until properly executed (signed, witnessed, and notarized as required by your jurisdiction). Always consult a licensed attorney before relying on any legal document for estate planning purposes.

1Acceptance of Terms

By creating an account or using Digital Heritage, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service. These terms constitute a legally binding agreement between you and Digital Heritage (operated by The Rosart Family, San Francisco, California).

2Description of Service

Digital Heritage is a secure personal legacy vault that allows you to store, organize, and selectively share important personal, financial, and legal information with designated family members or beneficiaries. The service includes document storage, a heartbeat monitoring system, beneficiary management, and tools to help you create draft documents for estate planning purposes.

We act solely as a storage and delivery platform. We do not review, validate, or provide any legal opinion on the content you store. The accuracy, completeness, and legal validity of any documents you create or upload are entirely your responsibility.

3Document Templates — Not Legal Advice

Any document templates provided through Digital Heritage — including will templates, advance healthcare directives, power of attorney forms, and any other legal document templates — are provided for informational and organizational purposes only. They are not a substitute for the advice of a licensed attorney.

A template generated or downloaded from Digital Heritage is a draft. It has no legal effect until it has been reviewed by a qualified attorney, properly completed, signed by the appropriate parties, witnessed as required by your state or jurisdiction, and notarized where required. Requirements vary significantly by state and country.

Digital Heritage expressly disclaims any liability arising from the use of document templates without proper legal review and execution. We strongly encourage all users to work with a licensed estate planning attorney.

4Your Account

You are responsible for maintaining the security of your account credentials. You must be at least 18 years of age to create an account. You agree to provide accurate information when creating your account and to keep that information current.

You are solely responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at [email protected]. Because of our zero-knowledge encryption architecture, we cannot recover vault content if you lose access to your account credentials.

5Subscriptions and Payments

Access to certain features requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select. All payments are processed securely through Stripe. We do not store your payment card information.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access to paid features until the end of your current billing period. We do not provide refunds for partial billing periods except where required by applicable law.

We reserve the right to change subscription prices with 30 days' notice. If you do not agree to a price change, you may cancel your subscription before the change takes effect.

6Heartbeat System and Vault Release

The heartbeat monitoring system is designed to detect when you have not checked in within a period you define. If the system determines that a release condition has been met, it will notify your designated beneficiaries according to your instructions. You are solely responsible for configuring the heartbeat system correctly and keeping your beneficiary information current.

Digital Heritage is not liable for any failure of the heartbeat system resulting from incorrect configuration, outdated beneficiary contact information, email delivery failures, or any other circumstance beyond our reasonable control. This system is a convenience tool, not a guaranteed delivery mechanism. We strongly recommend that you also communicate your estate plans directly to your family and attorney.

7Acceptable Use

You agree to use Digital Heritage only for lawful purposes and in accordance with these Terms. You agree not to use the service to store or transmit any content that is illegal, fraudulent, or infringes the rights of any third party; to attempt to gain unauthorized access to any part of the service or its infrastructure; to use the service in any way that could damage, disable, or impair its operation; or to impersonate any person or entity.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

8Limitation of Liability

Digital Heritage is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by applicable law, Digital Heritage and its founders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or any damages arising from reliance on document templates or the heartbeat release system.

Our total liability to you for any claim arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

9Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved in the courts of San Francisco County, California, and you consent to the personal jurisdiction of those courts.

10Changes to These Terms

We may update these Terms from time to time. We will notify you by email and with a prominent notice on the site before material changes take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
